Trump v. United States, 603 U.S. 593 (2024), is a landmark decision of the Supreme Court of the United States in which the Court determined that Presidential immunity from criminal prosecution presumptively extends to a President's "official acts" - with absolute immunity for official acts within an exclusive presidential authority that Congress cannot regulate such as the pardon, command of the military, execution of laws, or control of the executive branch. He also must be able to speak freely with his advisors, without fear of subsequent prosecution, to be able to consider all legal options presented.
Therefore, it becomes incumbent upon all of us to stop talking about prosecuting President Obama for listening to ideas discussed in the run-up of President Trump’s Inauguration in January, 2017.
However, this immunity does not extend to Clapper, Comey or Brennan.
The House Intelligence Committee had compiled the “egregious” errors by the CIA back in 2020 — errors that included burying intelligence that the Kremlin was preparing for a possible victory by Democrat Hillary Clinton, according to Director of National Intelligence Tulsi Gabbard.
“Not only did CIA Director Brennan, FBI Director [James] Comey, DNI [James] Clapper and others include the Steele Dossier in the 2017 ICA, they overruled senior Intel officials who warned them it was fabricated and should not be used,” Gabbard said, calling the move “the most egregious weaponization and politicization of intelligence in American history.
“In doing so, they conspired to subvert the will of the American people, working with their partners in the media to promote the lie, in order to undermine the legitimacy of President Trump, essentially enacting a years-long coup against him,” she added.
“The Russia Hoax was a lie that was knowingly created by the Obama Administration to undermine the legitimacy and power of the duly elected President of the United States, Donald Trump.”
Certainly, Obama could listen to these advisors and ignore any alleged illegal advice. And since it appears these cretins acted on their own, Obama is immune from prosecution.
And while I was never a fan of Barry O, I believe that the same standards must apply to him as it did for Trump. No matter what anyone wants to say otherwise.
After all, what is good for the goose, is good for the gander.
