Biden Poised to Cement His Legacy in History'sTrash Bin

Inside his less than sixty hours left in office, Joe Biden, soon-to-be Former President, is going off the rails to try and cement his legacy. He had previously given away Presidential Freedom medals like they were candy. And pardons like they were participation awards.
 
Now, in his final few hours, he is writing countless executive orders like they are Summa Cum Laude awards to block the incoming Trump agenda. But sadly, the Trump bulldozer will demolish all of these, and more soon after noon on Monday. Or within days thereafter.

On Friday night, CNN published a story where Biden actually believes the Equal Rights Amendment, which was passed by the Congress in 1972, but was never ratified within the original time written in the law, or its extentions, should now be designated as the Twenty-Eighth Amendment, giving him all sorts of authority to nullify the recent Supreme Court decisions related to abortion.

Accepting this as an Amendment is just ludicrous to even consider. The Amendment process under Article V is very specific. It is not an Executive Branch function to amend the Constitution.

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

If the Amendment fails, it is not up to the President to change the process. And the Archivist does not have the authority to just apply Biden's wishes, without considering the legal consequences and ramifications that was in the Amendment when it was written and passed originally by the Congress.

So, if he insists on going through with yet another illegal executive order, especially when it is not his to decide, he will cement his legacy in the trash bin of history.
